Terms of Service

Welcome to Gamena! These Terms of Service ("Terms") govern your use of the Gamena website, application, and related educational services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Account Registration

To use certain features of the Services, such as creating quizzes, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up-to-date. You are responsible for safeguarding your password and for all activities that occur under your account.

2. Use of Services by Students

If you are a teacher, school, or district allowing students to use Gamena, you represent and warrant that you have the authority to consent to Gamena's collection of student data as described in our Privacy Policy, and you are responsible for obtaining any required parental consent under applicable laws such as FERPA and COPPA.

Our Services allow you to upload materials (such as text or images) to automatically generate educational quizzes ("User Content").

5. Subscription, Trials, and Billing

Paid plans, included usage, add-ons, billing intervals, taxes, and trial terms are shown at purchase. You authorize Gamena and its payment provider to charge the selected payment method. Unless stated otherwise at checkout, subscriptions renew automatically for the same interval until canceled before renewal. Fees already charged are non-refundable except where the plan terms or applicable law require otherwise. We may change future fees or plan features with reasonable advance notice; changes apply no earlier than the next renewal where required by law.

6. Intellectual Property

Gamena and its licensors own the Services, software, designs, trademarks, and platform content, excluding User Content. Subject to these Terms and payment of applicable fees, Gamena grants you a limited, non-exclusive, non-transferable, revocable right to use the Services for their intended educational purpose. You may not copy, resell, reverse engineer, bypass access controls, or create a competing service from protected portions of the Services except where applicable law does not permit that restriction.

7. Privacy, GDPR, and School Responsibilities

Our Privacy Policy explains how we handle personal data. Where Gamena processes student or other personal data for an organization, the organization remains responsible for lawful instructions, notices, permissions, account administration, and responding to individuals. Eligible customers may enter into a data processing agreement covering GDPR processor obligations, confidentiality, security, subprocessors, assistance, deletion, and international-transfer safeguards.

8. Third-Party Services

The Services may interoperate with payment processors, identity providers, AI providers, links, or other third-party services. Their separate terms and privacy practices may apply. Gamena is not responsible for third-party services that it does not control, but this does not limit obligations that cannot lawfully be excluded.

9. Suspension and Termination

You may stop using the Services and cancel a subscription through the available account or support process. We may suspend or terminate access when reasonably necessary for non-payment, a material breach, unlawful activity, security risk, harm to users or the Services, or legal compliance. Where practical, we will provide notice and an opportunity to cure. Provisions that by their nature should survive termination—including payment duties, ownership, disclaimers, liability limits, and dispute terms—will survive.

10. Service Changes and Availability

We may improve, modify, or discontinue features. We aim to keep the Services reliable but do not guarantee uninterrupted or error-free operation. Scheduled maintenance, emergencies, internet conditions, and third-party dependencies may affect availability. Material reductions to a paid plan will be handled with the notice or remedy required by applicable law or contract.

11. Disclaimers

To the maximum extent permitted by law, the Services and AI-generated output are provided "as is" and "as available." Gamena disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. AI output can be incomplete, biased, or incorrect and is not a substitute for an educator's review, professional judgment, or required safeguarding. Nothing in these Terms excludes consumer guarantees or other rights that cannot legally be waived.

12. Limitation of Liability

To the maximum extent permitted by law, Gamena will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, or for lost profits, revenue, goodwill, or data, arising from the Services. Gamena's total aggregate liability arising from the Services will not exceed the amount paid by the customer to Gamena for the affected Services during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited, including where applicable fraud, willful misconduct, or death or personal injury caused by negligence.

13. Indemnity for Organizational Customers

To the extent permitted by law, a school, business, or other organization agrees to defend and indemnify Gamena from third-party claims arising from its unlawful User Content, unauthorized instructions, or material breach of these Terms. This section does not apply to individual consumers where prohibited and does not cover claims caused by Gamena's own breach or misconduct.

14. Governing Rules and Disputes

Applicable law and courts will be determined by Gamena's contracting entity and the customer's location or written order terms. Mandatory consumer, education, and data-protection rights remain unaffected. Before filing a claim, the parties should first try in good faith to resolve the issue through the contact channel below, unless urgent relief or law makes that impractical.

15. Changes and General Terms

We may update these Terms and will post the revised date. Material changes will receive reasonable notice when required. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; Gamena may assign them in connection with a reorganization or transfer of the Services, subject to applicable law. These Terms, the Privacy Policy, any data processing agreement, and applicable order terms form the agreement for the Services.
